How property is sold here

Fulton County follows Georgia's rules, with its own calendar and offices. Read the Georgia guide for how the state works.

Tax sales

Georgia sells the property itself at a tax sale, not a lien certificate, and the buyer gets a Sheriff's Tax Deed that gives only defeasible title until the owner's right to redeem is foreclosed or the title ripens under state law. The Fulton County Sheriff holds tax and levy sales on the first Tuesday of each month, from 10 a.m. to 4 p.m., in person on the courthouse steps at 136 Pryor Street SW in Atlanta, and moves the sale to the next business day if that Tuesday is a holiday. The sale list is posted as a PDF on the Sheriff's tax sales page and printed in the Wednesday Neighbor newspaper for four weeks before each sale.

Foreclosure sales

Most Georgia mortgage foreclosures are out-of-court sales under a power of sale in the security deed, held on the first Tuesday of the month at the county courthouse. In Fulton County the notices run in the county's legal organ, the Neighbor newspapers.

Assessed values

The Fulton County Board of Assessors values every property at fair market value each year and mails an annual notice of assessment for each property.

Transfer tax

Georgia's real estate transfer tax is $1 for the first $1,000 of the sale price and 10 cents for each additional $100, which works out to 0.1%, and Atlanta does not add a city transfer tax.

Land bank

The Fulton County/City of Atlanta Land Bank Authority acquires tax-delinquent properties from the county and city to return them to productive use.

Worth knowing

The City of Atlanta reaches into DeKalb County, so check that an Atlanta address is in Fulton before using Fulton's records.

Worth knowing

The Sheriff can rescind a tax sale within 30 days and refund the bid, and the tax deed is recorded within 30 days after payment.

Worth knowing

Excess funds from a tax sale go to the parties notified of the levy, who claim them by sending notarized forms and a 50-year title certificate to the Sheriff's Office.
