How property is sold here

Wagoner County follows Oklahoma's rules, with its own calendar and offices. Read the Oklahoma guide for how the state works.

Tax sales

Oklahoma sells the property itself at the county resale, not a tax lien. The Wagoner County Treasurer holds its resale each year on the second Monday in June for real estate with taxes delinquent at least three and a half years, after notice by certified mail and four straight weeks of ads in local newspapers. The highest bidder pays at the sale and gets a Treasurer's Tax Deed, and the Treasurer also lists county-owned property on its OKTaxRolls page.

Foreclosure sales

Wagoner County sheriff sales of foreclosed property are held most Tuesdays at 10:00 a.m. in the Sheriff's secretaries office on the second floor of the courthouse at 307 E. Cherokee Street in Wagoner. The list on the Sheriff's website shows properties about six weeks ahead, and the minimum bid is two-thirds of the appraised value.

Assessed values

The Wagoner County Assessor sets fair cash value each year from the prior year's sales, but taxable value can rise no more than 5% a year, or 3% for homesteaded or farm property, until the property sells or is improved.

Transfer tax

Oklahoma's documentary stamp tax is $0.75 per $500 of the sale price, paid to the Wagoner County Clerk when the deed is recorded, and Broken Arrow and the other towns add no transfer tax of their own.

Worth knowing

Broken Arrow, the county's biggest city, sits partly in Tulsa County, so check which county a Broken Arrow parcel is in before searching records.

Worth knowing

The County Clerk offers a free Eagle Fraud Guard alert that emails owners when a document with their name is recorded.

Worth knowing

The Clerk warns that companies offering to collect excess resale funds for a fee are not needed; former owners can claim them directly from the Treasurer.
