How property is sold here
Hampton city follows Virginia's rules, with its own calendar and offices. Read the Virginia guide for how the state works.
Tax sales
Virginia does not sell tax liens; after real estate taxes stay unpaid long enough, the locality sells the property itself through a judicial sale ordered by the Circuit Court. In Hampton the City Treasurer has run delinquent tax sales in house since 2015, using a contracted auctioneer, and sales are scheduled case by case and announced through public notice rather than on a fixed annual date.
Foreclosure sales
Most Hampton foreclosures are nonjudicial trustee sales under a deed of trust, held at the place named in the notice, often the Hampton Circuit Courthouse at 237 N. King Street. Notices are published in a local newspaper before the sale.
Assessed values
The Hampton Assessor of Real Estate reassesses all property every year as of January 1, with new values taking effect July 1 in the annual Land Book.
Transfer tax
Virginia charges a state recordation tax of $0.25 per $100 on deeds plus a city recordation tax equal to one third of the state tax, and the seller pays a state grantor's tax of $0.50 per $500, all collected by the Hampton Circuit Court Clerk.
Worth knowing
Hampton is an independent city, so the city government does the work a county would: the City Assessor, City Treasurer and Hampton Circuit Court Clerk handle values, taxes and deeds.
Worth knowing
Real estate taxes are due in two equal installments on June 5 and December 5.
Worth knowing
The Circuit Court Clerk's daily recordation cutoff is 3:30 p.m.
